Communication & Call Recording Compliance Policy

1. Purpose of This Policy

This policy outlines Parakeeet.ai’s procedures for:

  1. Ensuring compliance with Do Not Call (DNC), Opt-Out, and anti-spam regulations in all regions where we operate.
  2. Managing call recording and monitoring in compliance with global privacy laws, including one-party and two-party consent jurisdictions.

Our objective is to protect individual privacy, comply with applicable laws, and safe guard Parakeeet.ai and our clients from legal and reputational risks.

2. Do Not Call & Opt-Out Compliance

2.1 Scope & Applicability

This applies to all:

  • Outbound calls, SMS, and automated messages made via Parakeeet.ai’s AI agents.
  • Campaigns under Done-For-You (DFY) and Do-It-Yourself (DIY) plans.
  • All countries where client campaigns are active.
2.2 Internal DNC List
  • We maintain an internal DNC list of all contacts requesting not to be contacted.
  • Numbers are suppressed from all campaigns within 24 hours of the request.
2.3 National DNC Registry Checks
  • USA – Scrubbing against the National Do Not Call Registry.
  • UK – Scrubbing against the Telephone Preference Service (TPS).
  • Canada – Scrubbing against the National DNCL.
2.4 Opt-Out Process
  • Call Opt-Outs: Verbal requests are logged and honored within 24 hours.
  • SMS Opt-Outs: All messages include "Reply STOP to unsubscribe".
  • Email Opt-Outs: All marketing emails contain an unsubscribe link that removes the contact instantly.
2.5 TCPA Compliance (USA)
  • Calls/SMS are made 8:00 AM – 9:00 PM local time only.
  • No calls to DNC numbers unless documented prior consent exists.
  • AI auto-dialing to mobiles requires prior express written consent.
2.6 UK & Canada Compliance
  • UK (Ofcom/TPS): No calls to TPS-listed numbers without explicit opt-in. Silent calls under Ofcom thresholds.
  • Canada (DNCL): No calls to DNCL numbers without consent; consent records kept 3 years.

3. Call Recording & Monitoring Policy

3.1 Purpose

Parakeeet.ai records calls for:

  • Quality assurance.
  • Agent training & AI model improvement.
  • Compliance verification.
3.2 Consent Requirements

For California residents, we ensure:

Recording is legal if one party (caller or recipient) consents. In these jurisdictions, our AI agent acts as the consenting party.

Two-Party (All-Party) Consent States/Countries

Recording is only legal if both parties consent. Our AI agent will:

  • Play an automated message at call start:
    • "This call may be recorded for quality and training purposes."
  • If the recipient continues the call, consent is considered granted.
3.3 International Call Recording Rules
  • EU / GDPR: Requires explicit consent & clear privacy disclosure.
  • California (CPRA), Pennsylvania, Canada (PIPEDA): Require mutual consent.
  • Australia, New Zealand: Generally require informing the other party.
3.4 Opt-Out of Recording
  • If a recipient objects to being recorded, our AI will stop recording immediately while continuing the conversation if possible.
  • Clients may configure campaigns to disable call recording entirely.

4. Record-Keeping & Audit Trail

  • All DNC requests, consent proofs, and call recordings are stored securely.
  • ● Access is restricted to authorized personnel only.
  • ● Records are retained for minimum 3 years or longer if required by law.

5. Client Responsibilities

Clients using Parakeeet.ai must:

  • Provide contact lists obtained through lawful, opt-in methods.
  • Avoid knowingly uploading numbers on national or internal DNC lists.
  • Notify us of any direct opt-out requests they receive from leads.
  • Ensure their outbound campaigns comply with regional regulations.

6. Enforcement & Violations

When acting as a Data Processor:

  • Violations may result in account suspension or termination.
  • We reserve the right to audit client campaigns for compliance.
